German authorities have launched an investigation into a representative of the IG Metall union following accusations of an unauthorized audio recording at Tesla’s Gigafactory Berlin. The probe was initiated after Tesla management filed a criminal complaint last week.

Laptop Seized at Gigafactory Berlin

As reported by rbb24, police confiscated a laptop belonging to an IG Metall member at the Tesla Giga Berlin site on Tuesday afternoon. Prosecutors in Frankfurt (Oder) have confirmed that an investigation is underway concerning a potential unlawful recording of a private works council meeting. In Germany, recording non-public meetings without consent can be a criminal offense.

Tesla Alleges Union Representative Caught Recording

Tesla stated that employees at the Gigafactory Berlin alerted management after reportedly discovering that an external union representative, present as a guest, had recorded the session. Plant manager André Thierig posted on X that the representative was “caught in action,” which prompted the company to contact the police and file a formal complaint.

The seized laptop is now a key piece of evidence in the ongoing investigation, with authorities set to determine if any illegal recording took place.

IG Metall Denies Allegations

IG Metall has refuted the accusations, with representatives telling German media that Tesla’s claims are an attempt to influence upcoming works council elections. These elections are scheduled to take place at the Grünheide plant from March 2-4, 2026, with approximately 11,000 employees eligible to vote. In Germany, these elections are typically held every four years between March and May.

Context of Labor Relations at Tesla

This incident occurs against a backdrop of existing tensions between Tesla and organized labor in Germany. While works councils operate independently of unions, IG Metall has been actively involved at the plant and has previously voiced criticism regarding Tesla’s labor practices.
